Beta Policy

This Beta Policy applies while ChatlyHQ is offered in a public or private beta / pre-launch period before official launch. It explains that the Service is still under active development, that you may or may not encounter technical problems or errors, and that you alone are solely responsible for using the Service during this period. By creating an account or continuing to use ChatlyHQ during the beta, you acknowledge and accept this Beta Policy in addition to our Terms of Use, Privacy Policy, Cookies Policy, and Subscription Terms. 1. Nature of the beta / pre-launch Service
ChatlyHQ may be labeled BETA, preview, experimental, pre-launch, or similar before the official launch. During this period features, interfaces, APIs, automations, analytics, billing displays, and integrations (including Meta / Facebook Messenger and other beta channels) may change, break, be limited, delayed, or removed without notice.
You may — or may not — experience technical problems, software bugs, errors, outages, incomplete features, or unexpected behavior. Beta / pre-launch access is provided to help us test, improve, and stabilize the product. It is not a warranty that the Service is complete, error-free, or suitable for mission-critical production use without your own backups and oversight.
2. No warranty during beta
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE BETA SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that the Service will be free of bugs, defects, outages, data loss, incorrect message delivery, failed automations, incorrect analytics, sync errors, security incidents, or other software or operational problems.
3. Assumption of risk, sole responsibility, and release
By accepting this Beta Policy you acknowledge that software instability, incomplete features, and unexpected behavior are inherent to a beta / pre-launch period.
You alone are solely responsible for using ChatlyHQ during the beta / pre-launch period and for any results, losses, or consequences of that use — including decisions to send campaigns, connect Pages, or rely on automations while the product is still stabilizing.
You voluntarily assume all risks arising from your use of the beta Service, including but not limited to: lost or delayed messages; failed broadcasts or automations; incorrect AI replies; webhook or API failures; temporary loss of access; corrupted or incomplete contact/subscriber data; billing or quota display errors; and any business interruption or lost opportunities.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND HOLD HARMLESS ChatlyHQ, its owners, operators, affiliates, contractors, and suppliers from any claims, damages, losses, costs, or liabilities arising out of or related to beta instability, software defects, omissions, delays, or changes — whether based in contract, tort (including negligence), strict liability, or otherwise — except where such liability cannot be excluded under applicable law.
4. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ChatlyHQ AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE BETA SERVICE.
Where liability cannot be fully excluded, our aggregate liability related to the beta Service shall be limited to compensation for time lost because of a verified ChatlyHQ system problem only, or — if no such time-lost credit applies — the greater of (a) the amounts you paid to ChatlyHQ for the Service in the three (3) months before the claim, or (b) fifty US dollars (USD $50), except where a higher minimum is required by mandatory law. Paid amounts remain non-refundable as stated in the Subscription Terms.
5. Your responsibilities and legal compliance
You are solely responsible for: verifying critical outbound messages before relying on them; keeping your own records and backups of important customer conversations and configurations; complying with Meta Platform policies and all applicable laws of every country or authority where you operate or where your messages are received; and promptly reporting severe defects to support@chatlyhq.com.
ChatlyHQ is not responsible for your misuse of the Service or for any violation of law by you or your users. You should not rely on beta features alone for irreversible legal, financial, or safety-critical communications without human review.
6. Data and continuity
We apply reasonable technical measures to protect accounts, but beta environments may involve migrations, resets, schema changes, or feature rollbacks that can affect stored configurations or historical data. We are not obligated to preserve every beta configuration indefinitely.
Personal data remains subject to our Privacy Policy. This Beta Policy does not reduce any non-waivable privacy rights you may have under applicable law.
7. Changes and end of beta
We may update this Beta Policy, change beta terms, suspend beta access, or end the beta / pre-launch period at any time. When the Service exits beta, continued use may be governed primarily by the then-current Terms of Use and Subscription Terms; surviving limitations for events that occurred during beta remain in effect.
8. Acceptance
By checking acceptance, continuing registration, or using ChatlyHQ while it is marked BETA or before official launch, you confirm that you have read this Beta Policy, understand it, and agree to its terms — including that you are solely responsible for your use during this period and that you may encounter technical problems or errors.
If you do not agree, do not create an account or stop using the Service.
